Business Visa

There are various state nominated visa options available for migrants wanting to establish a
business or invest in Australia.

The visa categories also offer different streams depending on whether you already own a
business, want to start a business in Australia or if you want to invest in the Australia.

 

Business Innovation and Investment – subclass 188 (provisional)
This is a state-nominated provisional residence visa for business owners and
investors. It is a point’s tested visa and you must be invited to apply for the
visa.The visa includes five streams:

 

 

  • Business Innovation stream: for people with business skills who want to establish,
    develop and manage a new or existing business in Australia. Applicants must be
    nominated by a state or territory government.
  • Investor stream: for people who want to make a designated investment of at least
    AUD1.5million in an Australian state or territory and maintain business and
    investment activity in Australia. Applicants must be nominated by a state or territory
    government.
  • Significant Investor stream: for people who are willing to invest at least
    AUD5million into complying significant investments in Australia and want to
    maintain business and investment activity in Australia. Applicants can be nominated
    by a state or territory government or Austrade on behalf of the Australian government.
  • Premium Investor stream: for people who are willing to invest at least
    AUD15million into complying premium investments in Australia and want to
    maintain business and investment activity in Australia. Applicants must be nominated
    by Austrade on behalf of the Australian government.
  • Entrepreneur stream: for people who have a funding agreement from a third party
    for at least AUD200 000 to undertake a complying entrepreneur activity that is
    proposed to lead to either the commercialisation of a product or service in Australia or
    the development of a business in Australia. Applicants must be nominated by a state
    or territory government.

 

Holding this visa is the first stage before becoming eligible to qualify for a Business
Innovation and Investment (Permanent) visa (subclass 888).
Business Innovation and Investment – subclass 888 (permanent)
This is a state-nominated visa for business and investor migrants who hold a
four-year provisional subclass 188 visa and are seeking permanent residency.
The nomination requirements for this visa are based on the subclass 188 visa stream that you
originally applied for:

 

Business innovation stream

You must have been in Australia and held:

  • a Business Innovation and Investment (Provisional) visa (subclass 188) in the
    Business Innovation stream or the Business Innovation Extension stream
  • a Special Category visa (subclass 444)
    for at least one year in the two years immediately before you apply.

Investor stream
If you are applying for this visa in the Investor stream, you must have been in Australia and
held your provisional visa in the Investor stream for at least two of the four years
immediately before you apply.
In addition, you (or you and your partner combined) must have held a designated investment with
an Australian state or territory for at least four years.

 

Significant Investor stream

If you are applying for a permanent visa (subclass 888) in the Significant Investor stream,you must have held at the time of application a provisional visa (subclass 188) in the Significant Investor stream or in the Significant Investor Extension stream.

 

Premium Investor stream

If you are applying for a permanent visa (subclass 888) in the Premium Investor stream, you
must have held a provisional visa (subclass 188) in the Premium Investor stream at the time
of application and be nominated by the Commonwealth government. You must have held your provisional visa for a minimum of 1 year.

Entrepreneur stream
If you are applying for this visa in the Entrepreneur stream, you must have been in Australia
and held your provisional visa in the Entrepreneur stream for a continuous period of at least
four years immediately before you apply.

 

Business Talent – subclass 132
The Significant Business History stream attracts high calibre business owners
who have a proven successful business history and want to do business in
Australia.

Business owners will live in Australia and have a genuine and realistic commitment to
continuously maintain an ownership interest and participate in the daily management of their
business.

This is a state-nominated permanent residence visa for business owners and entrepreneurs.

You have a choice of two streams:

 

  • Venture Capital Entrepreneurs: people who have obtained at least AUD$1 million
    in agreed funding from an Australian venture capital firm, which is also an AVCAL
    member, to develop an innovation to a commercial stage.
  • Significant Business History: high level business owners who want to undertake
    significant business activity providing either, employment, exports or high level
    investment.

 

The subclass 132 visa is valid for five years with future options for additional permanent
residency visas or citizenship.

There is no points test for the subclass 132 visa.
